NOTICE OF INTENT TO REQUEST A RELEASE OF FUNDS March 13, 2016, City of Pittsburgh, 200 Ross Street, Pittsburgh, PA 15219, 412-255-2211 TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS On or about April 1, 2016, the City of Pittsburgh will request the U.S. Department of Housing and Urban Development (HUD) to release federal funds under Title 1 of the United States Housing Act of 1937, as amended, to undertake projects known as: 2015 Public Housing Capital Fund Grant Program The 2015 Capital Fund Grant provides funding to the Housing Authority of the City of Pittsburgh (HACP) for modernization, development and management improvements. HACP has identified among its various properties, the necessity for comprehensive and partial modernization and other capital improvements. With the use of funding from the Capital Fund Grant Program, the HACP can continue to be a quality provider of affordable housing within the City of Pittsburgh. Project and Area description Authority-Wide. Funds to be used for architectural /engineering technical services, resident services, protective services, miscellaneous section 504/uniform federal accessibility standards services, miscellaneous contingencies, program management services, management costs, concrete, demolition, hazardous materials abatement services, multifamily rehabilitation, and rehabilitation of non-residential structures in designated communities. These actions are subject to the terms and conditions established in HUD's environmental review procedures, regulations, 24 CFR Part 58, release of funds for supplemental HUD assistance. Programs covered by Part 58, as may be determined necessary to support the implementation of these projects in the future, is also herein being requested. The activities proposed using HUD funds are categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act requirements (NEPA). An Environmental Review Record (ERR) respecting the proposed projects and any subsequent phases has been made by the City of Pittsburgh. This Environmental Review Record (ERR), which documents the environmental determinations for these projects, is on File at the address listed above and is available for public examination and copying, upon request, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Public Comments on Finding All interested agencies, groups, or persons disagreeing with this decision are invited to submit written comments (on the ERR) for consideration by the City of Pittsburgh at the above address. Such written comments should be received at the above address on or before March 31, 2016. All such comments so received will be considered, and the City of Pittsburgh will not request the release of funds or take any administrative action on the proposed project prior to the date specified in the preceding sentence. Release of Funds The Housing Authority of the City of Pittsburgh will undertake projects covered by these funds. The City of Pittsburgh is certifying to HUD that William Peduto, in his capacity as Mayor, consents to accept jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Housing Authority of the City of Pittsburgh may begin activities to use the funds. Objections to HUD Release of Funds HUD will consider objections to its release of funds and the City of Pittsburgh's certification if received by April 18, 2016, or for a period of fifteen days following its actual receipt of the request only if it is on one of the following bases: (a) that the certification was not, in fact, executed by the chief executive officer or other officer of the applicant approved by HUD; or (b) that the applicant's environmental review record for the projects indicates an omission of a required decision, finding, or step applicable to the projects in the environmental review process; or (c) the grant recipient has committed funds or incurred costs not authorized by 24CFR Part 58 before approval of a release of funds by HUD; or (d) another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
