NOTICE OF CY PRES HEARING IN THE ESTATE OF JOHN R. MATIERN, dec. 02-14-03031. The Will of John R. Mattern, dec. reads in part as follows: "All the rest residue and remainder of my estate of whatsoever nature and where so ever situate, I give, devise and bequeath to Duquesne University to be used solely for jazz programming on its radio station, WDUQ." Since radio station WDUQ no longer exists, the Estate has Petitioned the Court to exercise its power of "Cy Pres" to carry out the Testators desire as closely as possible. The purpose of the Hearing is to determine the entity to receive the bequest to carry out the Testator's intent. A Hearing will be held on October 27, 2015 at 10:00 am before his Honor Judge Frank J. Lucchino, in Courtroom No. 1 on the 1 ih floor of the Frick Building, Pittsburgh, Pa. 15219. Any entity that meets the criteria and who wishes to be heard on this matter shall notify the Court and Robert F. McCabe, Jr., Esquire at 526 Broadway, Pitcairn, Pa. 15140 PO Box 175 before the hearing date.
